1. Scope

These terms and conditions apply to all bookings made on this website. By booking, you agree to be bound by these terms and conditions. These may change from time to time and you should visit our website regularly to check for updates. 

2. Parties to Agreement

2.1 The parties to this agreement are the Conservation and Land Management Executive Body established under section 36 of the Conservation and Land Management Act 1984 (CALM Act) (representing the Department of Parks and Wildlife) and you.

2.2 You must be 18 years of age or over.

2.3 You are responsible for the acts and omissions of all persons occupying the sites included in your booking.

2.4 Bookings are not transferable under any circumstances.

3. Commencement

This agreement commences when you check the box to confirm that the booking details you have entered are correct and that you agree to the terms and conditions of this agreement, and you activate the 'button' "Confirm booking".

4. Variation

These terms and conditions or any feature on or accessible through the website may be changed or discontinued at any time and any such changes will be set out on the website.

5. Confirmation email and booking number

5.1 Your booking is not complete until you receive an email at the address provided and confirmed by you at the time of booking. If you did not receive a confirmation email, contact us to confirm whether your booking was completed.

5.2 Keep your confirmation email safe, it is your proof of booking and you may need to produce it at any time during your stay. We may, at our absolute discretion, charge a fee of $10.00 per booking to send a duplicate confirmation email.

6. Arrival and departure

6.1 You may occupy your booked camp site(s) only after 2pm on the day of arrival and must leave before 10am on the day of departure.

6.2 If you fail to occupy the site during any night of the booking period without informing us, we may at our absolute discretion, consider that you have cancelled and release the site to other campers.

7. Guests

7.1 You may book for a maximum of 12 fee-paying guests (i.e. not including children aged 5 years and younger) that must include yourself.

7.2 The maximum number of guests indicated for each camp site or type of camp site includes children as young as 6 years. Having such a maximum number does not necessarily imply or mean that number of adults, concession card holders or older children can camp comfortably at that site. Use the information for the type and size of tent, campervan, caravan or camper trailer to decide whether there will be enough space for your particular needs.

8. Your details

8.1 You must provide full and correct details at the time of booking.

8.2 You must promptly inform us of any changes to the details you provided when you made your booking.

8.2.1 For second and subsequent changes to your details we may, at our absolute discretion, charge a change fee of $10.00 per booking.

8.3 Verifying your details

8.3.1 You must have proof of identity that you may be required to produce at any time during your stay and we may make take other steps to verify your details at any time.

8.3.2 If you cannot verify any of your details at any time we may, at our absolute discretion, declare your booking null and void, release the site to other campers and you will forfeit the full amount of all fees paid.

9. Fees

You agree to pay all fees & charges payable under this agreement. If you do not, you will be liable to pay those fees, including penalty fees, set out in the Conservation & Land Management Regulations, 2002, as amended from time to time.

9.1 Payment

9.1.1 Payments can only be made by MasterCard or Visa.

9.1.2 To secure information relating to your payment, all transactions are handled by the Commonwealth Bank “Virtual Payment Client” and no credit card details are captured or stored by us.

9.2 Camping fees

You agree to pay in full the camping fees at the time of booking to secure your booking.

9.3 Booking fee

We will not charge a booking fee for online booking and payment.

9.4 Change and confirmation request fees

A fee of $10.00 applies for each second and subsequent request to change your contact details and for each duplicate booking confirmation email you request. These fees are non-refundable and help to cover the costs of administering these changes and safeguard equity of access to park stays.

9.5 Park entry fees

9.5.1 The fee charged when you make your booking does not include park entry fees.

9.5.2 Information about park entry fees, including which parks they apply to and how to pay are available on this website. They are subject to change.

10. Requests by you to make changes to a confirmed booking

Changes to the dates, guests, and camp sites of confirmed bookings are not permitted.

11. Guests not included in bookings

If guests not included in your confirmed booking camp on the camp site(s) booked by you, we may, subject to the capacity of the camp site(s) you have booked and the maximum of 12 guests per booking, in our absolute discretion, permit them to stay on immediate payment of the applicable camping fee plus an additional fee of $10 per night for every additional person.

12. Cancellation by you

12.1 You must contact us by email to confirm you wish to cancel a confirmed booking

12.2 We will refund an amount dependent on the number of days between the date we receive your cancellation request and your previously confirmed arrival date:

12.3 Bereavement

In the case of the death of an immediate family member (spouse, civil partner, mother, father (including step parents), brother, sister (including step siblings), child (including step child), grandparent or grandchild) of a guest within 28 days before your confirmed arrival date we will, upon application made as soon as reasonably practicable but in any event within 28 days after the departure date of a confirmed booking and accompanied by a copy of the applicable death certificate, fully refund any unused portions of a booking.

13. Changes or cancellation by us

13.1 We retain the right to close any part of our parks without notice for management reasons or unforeseen circumstances such as, and not limited to, weather extremes or emergency reasons.

13.2 If we have to change your confirmed booking we will, where possible, offer you equivalent alternative accommodation for the period of the booking at no additional cost to you. If you decline an offer, or we are unable to offer an alternative, we will refund your fees for all the unused proportion of your booking.

14. Refunds

14.1 Online credit card payments

14.1.1 Refunds will only be made to the credit card account you used to make your payment via the Commonwealth Bank “Virtual Payment Client”.

14.1.2 Any claim by you for a refund must be received by us within 28 days of the departure date of a confirmed booking.

14.1.3 Refunds may take up to 30 days to be processed. 

14.2 Other payments

Where payment, in full or in part, has been made by another means, no refund of that payment will be made.

15.  Travel insurance

We recommend you consider taking out travel insurance at or before the time you make your booking for recovery of any costs, losses and expenses that we will not refund.

16. Maximum duration of stay and restricted return

16.1 Neither you nor any of the guests included in your booking may make a booking or combination of bookings for more than 28 consecutive nights or, if any of those nights fall outside of Western Australia public school term dates (i.e. those dates fall within Western Australia public school holidays) 14 consecutive nights, in any one park or reserve.

16.2 After a period of maximum stay, neither you nor any of the guests included in your booking or bookings may make another booking at that park or reserve with an arrival date fewer than 14 days later than your last departure date.

17. Breaches of any of the terms and conditions

17.1 In the event of any breach by you, or other occupants of the booked site, of the terms and conditions of this agreement, or of any applicable legislation or regulation including but not limited to the CALM Act, CALM Regulations, the Wildlife Conservation Act 1950, the Wildlife Conservation Regulations 1974, we may at our absolute discretion terminate this agreement and bar you from making further bookings by notice given to you, whether verbally or in writing.

17.2 On termination of this agreement, we shall treat the remainder of the booking period as cancelled.

17.3 If having been notified, whether verbally or in writing, that you are barred from making further bookings, you do make further bookings, we will cancel those bookings and you will forfeit all payment made.

18. Governing Law

This agreement is governed by the laws of the State of Western Australia.

19. Entire Agreement

This agreement constitutes the whole agreement between you and us and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.

20. Waiver

None of the terms and conditions in this agreement shall be waived except by written notice signed by the parties to this agreement.

21. Release and Indemnity

Neither the Conservation & Land Management Executive Body ("Body") nor the State of Western Australia ("State") shall be liable, in negligence or howsoever, for any death, injury or illness of or to, or loss of or damage to property, of you or anyone camping with you. You hereby indemnify & shall keep indemnified each of the Body & the State from & against any loss, cost, expense, damage, suit, action, proceeding, claim, demand, liability & cause of action incurred by or alleged or brought against any of those indemnified on account of you, or anyone else camping with you, initiating, bringing or alleging a suit, action, proceeding, claim, demand, liability or cause of action against either or both of the Body & the State in contravention of the previous sentence, or otherwise.
